Careers UPDATE ON EVICTION CASES (as of July 1, 2023) Supreme Court’s Emergency Order Regarding the Texas Eviction Diversion Program The Supreme Court’s Emergency Order Regarding the Texas Eviction Diversion Program expired on July 1, 2023. Notice to tenants: You may still be able to have some of the rent you owe paid and stop your eviction. Find out more about available rental assistance programs in your area at https://www.consumerfinance.gov/coronavirus/mortgage-and-housing-assistance/renter-protections/find-help-with-rent-and-utilities/ . If there is an available rental assistance program in your area, tell the judge you are interested in participating. Houston-Harris County Eviction Intervention Program The City of Houston and Harris County have been and continue to work together to serve as a resource to community organizations that help people facing eviction. The program provides rental assistance to eligible and approved tenants for past due rent to help prevent eviction. The program is administered by Catholic Charities of the Archdiocese of Galveston-Houston. Applications can only be submitted through community partners (EIP partners) that are located throughout Houston and Harris County. Landlords must agree to participate. For more information on the Eviction Intervention Program, visit https://houstonharrishelp.org . If you have an eviction court case number or have received a notice to vacate from your landlord and wish to apply, call 713-874-6609. Each of the 16 Harris County Justice Courts has a unique QR code to distribute to eligible tenants and landlords who wish to participate. Depending on eligibility and the availability of funding, you may receive up to 18 months of rental assistance from the program. If your household has already received rental assistance from the program, this would go towards the 18-month maximum. Your landlord must agree to the terms and conditions of the program before payments can be made. If you and your landlord agree to participate, payments can be made to either the landlord or the tenant, depending on agreed-upon preference. Harris County Community Services Department Eviction Defense Program Harris County’s Eviction defense program provides qualifying tenants facing eviction and seeking legal counsel the opportunity to meet with legal representatives in the justice court or county civil court at law where the eviction case is being heard. Harris County 1910 Courthouse News Justice Courts become technology leaders with software, server upgrades (Dec 2, 2021) We have learned that multiple of our Justice Court phone numbers are being used in a telephone scam targeting individuals across the country with stories of family members being in jail needing money or money being owed. Please know that these calls are not legitimate and are not being made by our court staff. We regret that this has occurred and hope that no one falls prey to these scammers. NEW FILING FEE FOR MOTION TO REINSTATE AFTER DISMISSAL. Effective January 1, 2024, a plaintiff whose case is dismissed and who files a motion to reinstate the case pursuant to Texas Rule of Civil Procedure 505.3 must pay the court’s civil filing fee of $54. See SB 1612, passed by the 88th Regular Legislature. NEW STATEMENT OF INABILITY TO AFFORD PAYMENT OF COURT COSTS OR APPEAL BOND IN ENGLISH AND SPANISH. The Supreme Court of Texas released an updated Statement of Inability to Afford Payment of Court Costs or Appeal Bond in both English and Spanish on October 20, 2022. Click here for the form. NEW REQUIREMENTS FOR JUDGMENT CREDITORS ATTEMPTING TO COLLECT THROUGH POST-JUDGMENT WRITS effective May 1, 2022. New Texas Rule of Civil Procedure 679b provides that in any post-judgment turnover order, order appointing a receiver under section 31.002 of the Civil Practice and Remedies Code, writ of garnishment, writ of execution, or other post-judgment order resulting in the freeze or seizure of personal property of an individual judgment debtor, the judgment creditor or receiver must serve the judgment debtor with the Notice of Protected Property Rights, the Instructions for Protected Property Claim Form, and the Protected Property Claim Form approved by the Supreme Court.
